WORCESTER – A local man faces charges for possession of ammunition, including armor-piercing ammunition.
Federal prosecutors charged Nial Luu, 31, of Milbury, on June 2 with unlawful possession of ammunition by a person subject to a court order restraining him from harassing, stalking, or threatening an intimate partner. Federal Magistrate Judge David Hennessy ordered Luu detained until a hearing on June 7.
According to federal prosecutors, Luu has an active order, issued by a California court, restraining him from, assaulting, threatening, abusing, harassing, following, interfering, or stalking a former intimate partner. Due to that order, Luu may not possess firearms or ammunition.
A search of Luu’s residence led to the discovery of 200 rounds of 5.56 mm ammunition marked as “green-tipped” or armor-piercing. The search also discovered 300 rounds of 9 mm ammunition. Prosecutors also say that components to assemble multiple AR-15 style rifles and Glock-style handguns. Four 30-round magazines were also seized.
The charge of unlawfully possession ammunition while subject to a court order restraining him from harassing, stalking, or threatening an intimate partner provides for a sentence of up to 15 years in prison, up to three years of supervised release and a fine of up to $250,000.
