Shrewsbury Nursing Home Faces Wrongful Death Lawsuit

SHREWSBURY – The estate of a woman has filed a wrongful death lawsuit against a local assisted living residence.

According to the civil complaint filed at Massachusetts Superior Court in Worcester, the representatives of the estate of Nancy McNamara claims that LCB Senior Living Operating, LLC (LBC), the operator of the Residence at Orchard Grove, as 258 Walnut St. in Shrewsbury:

  • Failed to follow and obey its own mission statement;
  • Created fake entries in the chart of McNamara;
  • Failed to follow McNamara’s care plan.

The complaint says that McNamara became a resident at Orchard Grove in 2019, when she was 85 years old. On December 4, 2021, staff found McNamara on the floor of her unit. EMS transported her to the hospital where she died on January 6, 2022. The death certificate lists the cause of death as “complications from blunt force injuries.”

McNamara was 89 years old at the time of her death.

The lawsuit claims that McNamara’s care plan requires escorts three times a day to and from meals, housekeeping twice per day, and a daily sponge bath. However, the complaint alleges that, despite her chart showing three daily checks, staff notes that she was not seen for over 18 hours.

When transported to the hospital, McNamara suffered from deep tissue pressure injuries resulting from unrelieved pressure on her body for extended periods of time. The injureies  occurred to her chin, cheek, head, fingers, wrist, left ear, left and right feet, and a large thickness wound on her right knee.
