Two Men Sentenced for False Reports to a Pension Plan

Two men and co-owners of a New Hampshire asbestos abatement company will avoid prison time after pleading guilty for false statements to a pension plan.

The federal District Court judge in Boston sentenced Richard Quinn, 58, of Sterling, and Gary McCaffrey, 66, of Salem, New Hampshire, on Tuesday, August 31, to each serve two years of probation with the first six months in home confinement. Both men will pay a fine of $25,000 and restitution of $337,416.

Quinn and McCaffrey both pleaded guilty to one count of making false statements to a pension plan covered by the Employee Retirement Security Act [ERISA].

The two men owned Absolute Environmental Inc, based in New Hampshire. According to court documents, the company continued to employ several undocumented individuals between November 2014 and May 2017, after being notified of their status.

According to prosecutors, Quinn and McCaffrey knowingly falsified reports to pension plans about the work performed by the undocumented individuals, failing to make required pension contributions of over $337,000.
